Terms of Service

1. Acceptance
By accessing or using PostCake (the "Service") you agree to these Terms, our Privacy Policy, and the Acceptable Use Policy in Section 5. If you're using PostCake on behalf of an organization, you represent you have authority to bind that organization.
2. The Service
PostCake is a social media scheduling tool and publishing API for short-form video and related content across third-party platforms including TikTok, Instagram, YouTube, LinkedIn, and X. The Service is provided on an "as available" basis during beta and may change without notice.
3. Accounts, API keys, and authority
You are responsible for activity performed under your account and API keys. API keys are issued per client and must be kept secret. Notify us immediately of suspected compromise. When you connect a third-party platform account to PostCake you represent that you own the account or are authorized by the account owner to publish on their behalf.
4. Third-party platforms
PostCake publishes content to platforms operated by third parties. Your use of those platforms through PostCake is governed by each platform's own terms and policies, and you agree to comply with them. In particular:
- YouTube Terms of Service and the Google API Services User Data Policy.
- Meta Terms of Service, Instagram Terms of Use, and Meta Developer Policies.
- TikTok Terms of Service and the Community Guidelines.
- LinkedIn and X user and developer terms for those connections.
PostCake does not control these platforms and is not responsible for their availability, content moderation decisions, or changes to their APIs. If a platform suspends or terminates your account you remain responsible for any fees incurred.
5. Acceptable use
You may not use the Service — and you may not allow your end users to use the Service — to create, schedule, publish, or distribute content or behavior that:
- is unlawful, infringing, defamatory, or violates the rights of others (including intellectual-property, privacy, and publicity rights);
- constitutes spam, fake engagement, coordinated inauthentic behavior, bot-driven amplification, or artificial follower / view / like inflation;
- promotes hatred, harassment, violence, or discrimination against people on the basis of protected characteristics;
- is sexually explicit, sexually exploitative, or otherwise adult-only content; or content sexualizing or endangering minors;
- promotes self-harm, eating disorders, or suicide; or depicts graphic violence or gore;
- is misleading, deceptive, deepfaked without disclosure, or designed to manipulate elections, public health information, or financial markets;
- facilitates illegal goods or services, weapons, controlled substances, regulated pharmaceuticals, human trafficking, or sanctioned-jurisdiction trade;
- promotes gambling, high-risk financial schemes, cryptocurrencies, multi-level marketing, adult dating, or other categories restricted by our payment processor's acceptable use policy;
- contains malware, phishing, or links to such content;
- scrapes, harvests, or otherwise extracts data from third-party platforms outside the scopes you were granted; bypasses platform rate limits; impersonates users; or attempts to reverse-engineer or disrupt the Service;
- violates the terms, developer policies, or community guidelines of any third-party platform PostCake connects to.
We may, at our discretion and without prior notice, refuse to publish, remove, or quarantine content that we reasonably believe violates this Acceptable Use Policy or the policies of a connected platform. We may report illegal content to the relevant authorities and to the affected platform.
6. Content ownership and license
You retain all rights to content you submit through PostCake. By submitting content you grant PostCake a worldwide, non-exclusive, royalty-free license to host, transmit, transcode, and otherwise process the content solely as required to deliver the Service — including publishing it to the third-party platforms you specify. The license terminates when the content is deleted from PostCake, subject to reasonable backup-retention windows.
7. Fees and payment
Paid plans are billed through Polar.sh, our merchant of record and payment processor. By subscribing you also agree to Polar's terms. Fees are stated on the pricing page, charged in advance, and non-refundable except where required by law. We may change pricing on 30 days' notice; changes apply at the start of the next billing period. Failure to pay may result in suspension or termination of paid features. Taxes are added where applicable and may be collected by Polar on our behalf.
8. Beta features
Features labeled beta, preview, or experimental are provided for evaluation, may be changed or withdrawn at any time, and are excluded from any uptime or support commitments.
9. Suspension and termination
We may suspend or terminate access immediately if you breach these Terms (including the Acceptable Use Policy), if required to protect the Service or a connected platform, if your payment method fails, or if continued service would expose PostCake to legal risk. You may stop using the Service or delete your account at any time from the dashboard. Sections 5, 6, 10, 11, 12, and 14 survive termination.
10. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. POSTCAKE DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. POSTCAKE DOES NOT WARRANT THAT POSTS WILL BE DELIVERED ON TIME, THAT ANALYTICS WILL BE COMPLETE OR ACCURATE, OR THAT THIRD-PARTY PLATFORMS WILL REMAIN AVAILABLE OR COMPATIBLE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA. POSTCAKE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNTS YOU PAID TO POSTCAKE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnity
You will defend, indemnify, and hold harmless PostCake from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) your content, (b) your or your end users' breach of these Terms or any third-party platform terms, or (c) your violation of applicable law.
13. Governing law and venue
These Terms are governed by the laws of the jurisdiction where PostCake is established, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the competent courts of that jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.
14. Changes
We may update these Terms. Material changes will be posted here with a revised "Last updated" date and, where reasonable, announced by email. Continued use after the effective date constitutes acceptance.
